Order

         In consideration of the petition to investigate, together with documents R.1 through R.3 already in evidence, (the Court) hears that on 26 January 2003 at about 04:00 hrs, approximately 300 - 400 'menacing men' entered the disputed location ( 'Sukhumvit Square' - editor. ) and carried away property and destroyed property, and then blockaded this (same) disputed location, without having legal authority to do so.

         Said actions caused the Defendant (BRT Holdings) not to be able to access the disputed location (Plaintiffs in Case (black) No. 11044/2544 of this court), which Defendant (BRT Holdings) believes said action was brought about by Plaintiff (Tisco Securities PLC) (Defendants in Case (black) No. 11044/2544 of this court) and their 'followers'. In addition to which, within the disputed location there remains the property of the Defendent (BRT Holdings) and their 'followers', necessitating that they (BRT Holdings) enter, but are unable to enter the disputed location.

         Arising from this blockade, an emercency case exists. It is seen that the Defendent (BRT Holdings), was the original occupant of the contested area prior to this court case. This case is still under consideration of the Court and it is still unresolved as to whether or not the Defendents have the right to occupy the disputed land. The Defendent's petition has sufficient merit and it is necessary that they temporarily protect the interests of Defendent before judgement is made.

         Therefore it is the order of this Court that the Plintiff (Tisco PLC) and all of their 'followers' are ordered off of the disputed land. The Plaintiff (Tisco PLC) and the followers of the Plaintiff are forbidden to enter and to disturb possessions on the disputed land any further until the case is finally resolved.
